Railroad Right-of-Way Condemnation Litigation

 
 

On November 15th 2003, the United States government agency exclusively governing the operations of railroads in America, the Surface Transportation Board, issued a decision which granted a Notice of Interim Trail Use, ( “NITU” ) for 47.8 miles of the former K&O Railroad right-of-way including the 100’ right-of-way in Comanche, Kiowa and Pratt Counties, Kansas from railroad milepost 589.2 at Coats, Kansas to railroad milepost 636.0 at Protection, Kansas and including the 100’ right-of-way in Hodgeman County, Kansas from railroad milepost 36.3 at Hanston, Kansas to railroad milepost 47.0 at Jetmore, Kansas. 


Consequently any Kansas landowners owning property on November 15th, 2003 which borders the 100’ right-of-way, qualifies as a potential beneficiary of condemnation damages from the federal government. However, any claim seeking these damages must be filed in the appropriate federal court before November 15th, 2009 or your claim will be forever barred.
